Terms of Use

These Terms of Use took effect on 4 August 2026.

These Terms of Use govern your access to braindpower.com and to the Braindpower platform. Please read them carefully — they set out what you may do with the service, what we commit to, and how liability is allocated between us.

Acceptance of These Terms

By visiting the website, requesting a demo, or logging into the platform you agree to these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind it. If you do not agree, do not use the service.

Where a signed subscription agreement exists between your organisation and Braindpower, that agreement prevails over these terms to the extent the two conflict.

Eligibility and Accounts

• You must be at least 18 years old and legally able to enter into a contract.
• Account details must be accurate and kept up to date.
• Credentials are personal: do not share them, and tell us immediately if you suspect they have been compromised.
• You remain responsible for everything done under your account, including by members of your team.

Use of the Platform

We grant you a non-exclusive, non-transferable right to use the platform for your own internal business purposes during your subscription. You agree not to:

• Copy, resell, sublicense, or make the platform available to anyone outside your organisation.
• Reverse engineer, decompile, or attempt to derive the source code or the underlying models.
• Scrape, bulk-export, or systematically extract data beyond the export features we provide.
• Interfere with the service's operation, probe its security, or circumvent rate limits and access controls.
• Use the platform to process data unlawfully, to harass or profile individuals, or in breach of any social network's own terms.

Subscriptions and Payment

Paid plans are billed in advance for the agreed term and renew automatically unless cancelled before the renewal date. Fees exclude taxes unless stated otherwise. Late payment may lead to suspension after notice. Except where the law requires otherwise, fees already paid are non-refundable.

Intellectual Property

The platform, its interface, documentation, models, and the Braindpower name and logo belong to Braindpower and its licensors. Nothing in these terms transfers ownership to you. Content and data you upload remain yours; you grant us only the licence needed to host and process it so we can provide the service.

Third-Party Services and Data Sources

The platform analyses content from social networks and other public sources through their APIs and other permitted channels. Their availability, coverage, and terms are outside our control and may change without notice. Analyses, scores, and forecasts are decision support only — they are not guarantees of outcome and should not be your sole basis for a business decision.

Disclaimer of Warranties

The service is provided "as is" and "as available". To the extent the law permits, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the service will be uninterrupted or error-free or that results will be complete or accurate.

Limitation of Liability

To the extent the law permits, neither party is liable for indirect, incidental, or consequential loss, nor for lost profits, revenue, goodwill, or data. Our total liability arising out of the service is limited to the fees you paid in the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot lawfully be excluded.

Suspension and Termination

You may stop using the service at any time. We may suspend or terminate access if you breach these terms, if your payment is overdue, or if we must do so by law — with prior notice unless the risk requires immediate action. On termination your right to use the platform ends, and we will make your data available for export for a limited period before deleting it.

Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of İstanbul have exclusive jurisdiction over any dispute, without prejudice to mandatory consumer protections in your country of residence.

Changes to These Terms

We may revise these terms as the service develops. Material changes are announced through the platform or by e-mail before they take effect, and continued use after that date means you accept the revised terms.
