TERMS OF SERVICE

BraindPower These Terms of Service (“Agreement”) govern the use of the BraindPower social media analytics platform (“Platform”) provided by Alpaco Yazılım Teknolojileri A.Ş. (“Company”). By accessing or using the Platform, you agree to be bound by this Agreement.

1. Parties

This Agreement is entered into between Alpaco Yazılım Teknolojileri A.Ş. and the individual or legal entity using the Platform (“User”).

2. Service Description

BraindPower is a SaaS platform that enables: ● Analysis of social media accounts ● Measurement of performance and engagement metrics ● Generation of reports and insights ● Data-driven decision support

3. Account Registration and Responsibility

● Users must provide accurate and up-to-date information. ● Users are responsible for maintaining the confidentiality of their account credentials. ● All activities under the account are deemed to be performed by the User.

4. Social Media Account Integration

● Users may connect third-party social media accounts to the Platform. ● Users represent that they have the necessary rights and permissions to connect such accounts. ● The Company is not responsible for interruptions or errors caused by third-party services.

5. Acceptable Use

Users agree not to: ● Use the Platform for unlawful purposes ● Attempt to harm or disrupt the system ● Gain unauthorized access ● Reverse engineer or attempt to extract source code ● Use data without proper authorization

6. Intellectual Property

● All rights related to the Platform, including software, design, and content, belong to the Company. ● Users are granted a limited, non-transferable, non-exclusive license to use the Platform.

7. User Data and Content

● Users are solely responsible for the data they provide. ● Users confirm they have the legal right to use and share such data.

8. Fees and Payments

● The Platform may offer free and paid plans. ● Payment terms will be specified separately where applicable. ● Failure to pay may result in suspension of services.

9. Suspension and Termination

The Company may suspend or terminate access if: ● The Agreement is violated ● The Platform is used unlawfully ● Security risks are detected

10. Limitation of Liability

● The Platform is provided “as is” without warranties. ● The Company is not liable for indirect, incidental, or consequential damages. ● The Company is not responsible for third-party service failures.

11. Third-Party Services

The Platform may integrate with third-party APIs and services. Their terms apply separately.

12. Privacy

User data is processed in accordance with the Privacy Policy.

13. Modifications

The Company reserves the right to update this Agreement at any time.

14. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices shall have exclusive jurisdiction.
